    If it makes you feel any better, I just emailed ebay about another user. I won an $8 item (actually $3 plus $5 for shipping). I paid via paypal within 3 days (on 6/5/05). The payment went unclaimed through paypal. I receive an email from the seller asking for payment. I reply saying I paid on 6/5 and included a copy of paypal's email. The email got returned undeliverable. I said screw this. I canceled the payment (which you can do when it goes unclaimed for weeks). I emailed him through ebay asking to send another invoice and I'll pay asap. No response. I ask ebay for the contact information and his phone number is disconnected. Now I just emailed ebay saying a user is using false contact information. I don't want to get a negative strike when I paid on time, especially for an $8 transaction. The loser had 96-97% feedback so I should have known.

    well, just talk to lingjr.
    you must ask paypal get back money.(say you wrong bid and sender did not send over sea in this action) in case you sended money.
    because he list the action for "HONG KONG" only.

    Hi Ricky

    First off thank you for your help on the PS2 issue. I did appreciate it very much. On lingr I did ask him to refund my money no response. It was not till I had an item strike that I was mad. He listed on the auction S&H us so by all rights I did what it said so an item strike was very unfair. Also, he had same item in us auction that ended 15 minutes later which ended with no bidders why not ask for 4.00 more and consider it for that auction. To me this whole thing sounds fishy. As if he has people who bid up his auction to get a price he really wants.

    At the very least I expect my money back and if he ever wants me to consider buying from him again I would expect an apoligy and the strike removed also. He made the mistake if it was not to be shipped to us by including S&H for US in his auction.

    As far as eBay is (or should be) concerned, he made it perfectly clear that he was willing to ship internationally. The fact that he only entered HK in the check box section of the auction setup is negated by his repeated mentioning of shipping to the US and the link to his "me" page which further mentions that he will ship internationally. Also, it would have been simple to restrict all bids to those actually in HK with a single checkbox during the auction setup. Be thankful that he didn't just say that he shipped it and it got lost instead.

    You can trust I really hope to be proven wrong. I would be glad to say that but at this point he has given me no reason to say that. But, Like I said on the ebay strike that should never have happened. If he made a mistake on the auction great let me know you wont ship it but don't make matters worse and have ebay penalize me because of your mistake. That is not right!!!!
    It is also not legal. This falls under both defamation of character and libel from both the seller for his feedback, and eBay for keeping the feedback. Sadly, eBay does not ever seem to want to remove feedback even when it is obviously and without a doubt false. Your only option might be a mutual removal for the feedback. In the meantime, you should make a feedback response so that people looking at your feedback get your side of the story (it should be similar to the feedback that you left for the seller). If you get your money refunded and have the feedback mutually withdrawn, your response will go with it. I know I feel more comfortable with a seller when he/she has taken the time to respond to negative or neutral feedbacks.

    Luckily eBay now owns Paypal, so they should be able to compare the account information for the eBay seller and the Paypal payment receiver with relative ease. Just make sure to continually follow up with both of them.

    His complete auction was handled in a very bad way. Balls in his court to make it right. Until that day happens he has my cash, he has my item and he nailed me on ebay..sounds like I was had.
    If you used a credit card through Paypal (I know I always do with something over $100 or something bought outside the US), then you should give eBay/Paypal a week to respond then begin a chargeback. They will get pissy with you and may threaten to revoke your Paypal account if you do it again, but I have yet to see how they can legally do so without running afoul of FTC and other banking regulations.

    No problem (my wife keeps saying that I should have gone into law, but I hate courtrooms). I just hope that you can get your money back without much more trouble.

    i think anyone with half the brain the first thing would be rejecting the Paypal payment and explain the item cannot be shipped outside the HK... also striking unpaid claim without even checking first is big no no. I had once a seller filed the unpaid claim when I paid via Paypal on the day the auction was ended. At the end he eBay removed the strike and the seller attempted to remove the negative feedback each of use left for one another... I told the seller in very polite term where he could go and shove something up his...(basically I told him go f*ck himself) :p

    Now when I won eBay auction I usually wait till the sellers contact me not the other way around and pay on the last day specified in the auction - usually 7th day once the auction ended. I figure since it's me spending my money why I should do the all the work - I don't go to the shop and take the item out of the warehouse, bring into the shop, put the price tag, scan, run the tilt and etc. I just ask for the item I want and pay what they want...

    You would think. Now to top it off he has not replied to any of my emails, not sent my money back but did leave me negative feedback. What a jerk. You would think by reading my negative feedback you would have a friggin clue I have money I need to send back...Anyways, I called my credit card company and they said before I could dispute it it had to be 3 days so in three days I will fill out a dispute paper. Add all the emails of he would not ship item and hope they will refund my money and go after him for prosecution. At the same time since the press is always looking for a credit card fraud ebay story I may call some of the news channels up. I know lately here in the bay area seems they can not get enough of that. Ebay will love it.

    That is great news. Now you can really hit eBay hard to remove both the unpaid strike (since you obviously did pay) and the negative feedback (since it is now categorically libel). If nothing else, just see if LINGR will mutually remove it.

    Well, I think I would have received a free Sony jacket too. At least it was in the picture. I would hope I do for that price.

    Well you cant expect people to just reply to e-mails without giving them time. Also remember there is a time difference between you and him.

    So sending 8 e-mails isnt the way to go forward. You also shouldnt of left negative feedback so soon...

    That was a silly thing and thats most likely the only reason why you got negative feedback as well.

    well if a seller files the non-payment claim when I already paid for the item without even asking me first I'd left the negative feedback in no time... :p

    Give me a break. If you screw up on a listing you should not give the buyer a non payment strike. No matter how you look at it he was wrong. If you think the strike was fine than maybe we should remember it when you win won of our auctions and do it to you and than say we did nothing wrong.

    As for neg feedback he fired first with the non payment strike after I received it I left negative feedback. ALso that is when I listed this message. No matter how you look at it. In his situation with how his auction read you should not complain to ebay so the buyer will get a strike.

    IN the end I believe dj898 is right wait till the last day to pay. At least I would not have had the money issue.

    Thing is, from everything posted Macwest gave Lingjr plenty of time. It was Lingjr that posted the unpaid item strike AFTER the auction had closed and Macwest had paid. That's not "sorting out problems" that's purposefully lying to eBay to try and get out of paying eBay fees.

    To do that, refuse to refund money and ignore email is right out wrong and dishonest.

    The auction clearly stated shipping to the US. Lingjr can claim whatever he wants about it being a mistake, but he advertised it for sale. He has no right to change his mind after the auction is closed than a bidder does. Not completing a sale is just as bad no matter if you are the bidder or the seller.

    Topping it all off with retaliatory negative feedback just proves that Lingjr wasn't interested in working with Macwest. If he were, he would have 1) responded to one of his emails, 2) refunded his PayPal payment ASAP (it takes a single click on the PayPal site) and 3) never falsely filed an upaid item strike.

    The first two can be attributed to general slowness with checking email or time zone differences. If that is all it was then yeah, I would say that Macwest was over-reacting. The false filing of an unpaid item strike though is perhaps the biggest indicator of Lingjr trying to screw Macwest and that was done before any nagative feedback was filed.

    Macwest> You should post a follow-up reply in Lingjr's feedback after his response to yours. Ebay feeback allows for original feedback (by original poster), response (by other party) and follow-up (by original poster). The more information you can leave the better it will help other bidders in the future.
