There needs to be some time limit, 30 days is probably the best. It acts as a spam deterrent for those who spam their way to 50. For those types it is more the presence of a waiting period than it's length.
I think we should go with 50 posts and 30 days (voted) and see how it works. If needed be we can then increase it to 60 days.

yep gone for 50 posts and 30 days too, if it doesnt work increase it to 60 days, then 90 if that doesnt work etc.
I have voted for 90 days.
What I really want to see is the rules stickied permanently at the top of the marketplace section and harsher punishments to ALL members for not following them.

Where's the 100 posts and 90 day option! 50 posts is far too low to get a feel for someone, especially if their posts are short and sweet fillers only (as is often the case).
I don't know how many new members join each day / week / month etc, and of those, how many actually hit 50 posts within 1-3 months, but I don't imagine it to be a particularly high number. Personally I think once someone hits 50 posts that should only qualify them for Marketplace sales consideration. At that point a Mod should have a quick skim through the member's posts to date to make a more informed decision on their selling rights here.
50 posts of 'Wow, cool' or 'Awesome, I agree' = someone I won't do business with.
Edit - So in the absence of 'other', I'll vote for the harshest option above.

50posts and 90 days seem fair enough. Took me 90 days to get 50 posts when I first signed up. I think that time should give senior members plenty of space to see if the new member is a good one, troll, or just another spammer/ bot.

A greater amount of posts/days could lead to safer trading but in the other hand will turn off people that might want to sell their stuff on a forum and not on eBay and that usually is a good thing...

If someone came with a ultra rare unreleased game or something - they could quite easily PM assembler and provide him with as much proof as he requires. Then an exception can be made for that person, with assembler posting the first reply to that persons thread saying he has OK'ed it.
There are always exceptions to the rule - but those are much rarer than what generally happens, and the rules should fit the common situation.
