    For the extra money to ship to a US address first, it probably could've helped raise Germany shipping to a safer class. I mean sending a $500 item insecurely ANYWHERE is suspicious in my book.

    I didn't send the item unsecured. I followed proper protocol. He submitted questions, I answered them all, I said I didn't ship internationally, he said okay. He paid with an address in Texas, I shipped to it with signature confirmation. His refusal to get the item is what is at issue here, despite the item being there for weeks and his own admission that his relative had no problems getting other packages.

    I just want my money back. Simple as that.

    @nds_demo: Nobody is going to deal with you. Who would want to sell you something only to have YOU say "I decided I don't want it anymore so I won't accept the package. Give me a refund when it arrives".

    That's not how Ebay works, NDS_Demo. You are contracted to purchase my item. You paid, I sent. That was it. The money was in my account. The money was spent. Therefore, it was my money. The item is sitting in the post office of the town YOU had me deliver to.

    You said it yourself that other packages had been delivered, why not this one?

    Again, answer my question. Why do you want a refund?

    Wow this really sucks. This is one of those scenarios that makes me nervous with ebay paypal. I keep what I call my nuclear option. Basically to call my credit card company and tell them it's an unauthorized payment. Definitely not the best way since it burns that bridge, but I always keep it in my back pocket for any item for than $100. That's one reason I like to try to sell on forums first. Then paypal is the only thing I have to deal with. Good luck Borman I hope you get this all sorted out.

    Man, quite a sticky situation. Borman didn't do anything wrong. Even though the money is yours, spending it before the buyer has it in had isn't really the best idea. I mean, I know where you're coming from, funds are tight with the honeymoon and all. But what would you do if you spent the money and the item was damaged? You'd still be screwed right? I don't use eBay very often, but don't they freeze the funds until the buyer receives it? So letting an item sit in a post office counts as the item being delivered, even though it hasn't been picked up, therefore you have access to the funds?

    If the item is damaged, then USPS takes care of it. They do not freeze the money. If they had, I would never be able to ship anything, since I don't have money laying around to ship 17$ plus packages. Regardless, I don't let money sit in my Paypal account, so there still wouldn't be money in there.

    I am more than understanding when there are issues. I've had items get broken in the mail before, I know the process behind that. Ebay does not allow for 'Buyer's Remorse,' which is exactly what is going on here. It isn't a hypothetical situation where an item gets damaged.

    I've done everything by the books, NDS_Demo has not.

    What a shitty thing to do.

    If you win an eBay auction you are obliged to pay for the item.

    If the item fails to materialise you are entitled to make a claim BUT if the item is at the post office and you can't be arsed arranging for a redelivery or making a collection, you have NO right to a refund.

    If you don't want the item don't bid on it. If you can no longer afford it, you should try to resolve the issue in a timeley manner with the seller directly. If that doesn't pan out, as they are not obliged to refund you without fault, then you can always resell it but you should certianly NOT file a claim when you have NO right to do so.

    Frankly you should be taken down a dark alley, mugged, raped and shot but not necessarily in that order either.

    The thing is, they even tried to redeliver it on June 2nd, after it sat in the post office since May 19th. There is absolutely no excuse. He just needs to admit that he doesn't want the item anymore. And if that were the case, I would have been more than happy to work with him. That would have given me a chance to receive the item, and try to resell it so that no one loses anything.

    On top of the shipping that I won't receive back if he wins (regardless of what he says), Ill likely have to pay for the cost of it being returned to me as well.

    Happy Birthday to me!

    Edit : And I am pretty sure getting the 'heebie jeebies' is not a valid excuse to return an item.

    Most of the time when you ship an item with insurance/tracking, things like damaged deliveries also are covered by the insurance of transportation company.

    It's a horrible situation to be in, even though it was the other way around for me (being I was the buyer) the seller scammed me and there was a chance that my $300 wouldn't be returned.
    I personally, don't think you have anything to stress about cause I'm sure you'll get your money back. PayPal, just leaves you hanging for a few weeks and it really bugs you.

    Been reading this and have been in a situation where PP had removed funds from my account while a claim was being made.

    One thing in Australia which i am not sure if you have something in the US is that there is a thing called a Financial ombudsmen which you can lodge complaints directly online with.
    They really don't like PP here in Australia as they are like a fully unregulated bank. Once the complaint is in I have notified PP that this is the case and within 1-2 days I have received my money back and the matter closed.
    PP call it a reimbursement in good faith or some shit like that. The reason they do it is that to just fight a complaint from the ombudsmen it costs there between $1000-$1500 so refunding you up to $1K is better for them.
    I know of a few people here in Oz that have done it.
    BTW i have stopped using eBay long ago and just move things VIA forums. Save on fees and really have never been f@#ked around

    Wrong. It's his money the second you pay him. The second your item leaves his hands, it's yours and it's your responsibility. If you loose it and don't pay for insurance, if you decided you don't want it, whatever, it's your problem.

    If you contracted some Chinese manufacture to make something for you, then it got made and sent out, you can't go "I don't want it anymore. I won't accept it". Well, correction: You can do that if you want, but it would be a day in hell before anyone refunds you for it. If you send it back, if you throw it into the sea, that's your business. If it ever arrived back at the premises, it would just be refused as "Item sold exactly as requested. No longer our goods. Pay to have it sent back, or it will be destroyed.".

    In common sense land sure. Ebay sellers effectively don't get their money untied for 45 days. As long as the item is eligible to have an ebay or paypal case opened, one risks getting into hot water if they spend the payment.
