I have trouble again with eBay, need help!

I've ordered a bag from an Australian seller, which I paid for on 29th of February and still hasn't arrived it's been 5 weeks! It was shipping with tracking number but it doesn't work, I've tried the tracking site comes up negative. With that, I messaged the seller about 5 times regarding that I haven't got the bag, nor have I even been able to track it. His answer was
"My wholeseller has let me down, packages arrive just they take 5 weeks to" - Notice he didn't answer any questions regarding the tracking number? So anyway I waited 5 weeks, and since that's over 45 days I can't dispute this, I paid with a eCheque so PayPal can't do anything about it according to the resolution centre (unless I read that wrong), PayPal closed the case as it was over 45 days, but I had to wait an extra week as the seller said it would arrive on the 5th week!
So far I'm waiting to hear from eBay, I've reported the seller for ignoring my recent messages and gave him negative feedback, but still that doesn't get me my money back.

Is there anything I can do now or do I have to kiss my money good bye?

sad to say mate but you have probably lost the money, you should have submitted a case immediately as I have known plenty of sellers to keep you hanging on until the case submission date has passed and then suddenly change their attitude once you have no way of getting your money back

gutted for you dude but hopefully wasn't too much

It sounds like your money is long gone to be honest. Rule of thumb is if it makes it past a month and your gear hasn't shown up you file a dispute.

I don't think you realize how long it can take to get mail from au to us.

    2-3 months unless air.

    was it sent surface?

I hope you either get your money back or get the bag somehow.
Although I hate sellers with that attitude, I have had packages arriving after 6 weeks... and most of the times these came from the same state/country and with the same courier where other items took only 2 weeks...

Okay, well this guy was shipping from his wholesaler from China, now he mentioned it takes 3 weeks, then changed to 5 weeks. Only reason why I believe I've been scammed is that
    A) He stopped responding to my emails regarding the tracking of the package
    B) The tracking number never, ever worked hence point "A"

I'm still waiting to hear from eBay I've messaged them regarding he's possibly scamming me.

Just to answer you directly Kev, I'm aware about shipping times of place I order from and I usually check with the seller beforehand of possible delays. My sister mentioned that say you ordered a package from Japan by SAL which can take a very long time, ebay's claim deadline is 45 days what if the package never, ever arrived? What exactly happens then? Specially if the seller ignores you.

You have a long time to do a chargeback, but if he isnt replying it's a bad thing.

As a longtime ebay seller/buyer all I have to say is next time dont message eBay and wait for a response, it can take FOREVER. Call them, there customer service is pretty on the ball and if you have a good feedback record they will generally work with you to resolve things in your favour. I have had many cercumstances where they have helped me, like a seller charging me tax even though the sellers ad never said they would and ebay have allowed me to not pay without having a non payment strike go against me and as a seller myself I have had customers say they never received something and left negative feedback and I had proof that they did through my tracking number and ebay reversed the negative feedback. Anyways, Im not saying its always easy but Ive managed to maintain 100% positive feedback for 6 years now and I would say my main secret is calling ebay whenever I have problems. Oh and regarding Paypal, same deal. Always call them, they have helped me get my money back many times and not just regarding ebay purchases but from other sites as well.

I hope you are able to work things out and if you ever need any advice or help with ebay feel free to PM me.

I second calling them both Paypal and Ebay. It's really hard to ignore you then. If it's worth the amount of money, it's worth the time.
I don't know what an eCheque is exactly so I don't know the rules.

An E-Check is a form of payment that deducts funds directly from your own standard checking account which are usually managed by third party companies that interface with a number of different banks like Paypal and such. It's a handy option as a buyer on eBay when you dont have a credit card but its really annoying to deal with as a seller because it can take like 10 days sometimes to process. Either way though, its the same process when trying to obtain a refund.

Yeah honestly the best thing to do with those long deals is to open a dispute before the time period ends. I've had to do this before and just explained to the seller that it was a precaution and as soon as it arrived I would mark it as such in the dispute. That way it's open so stalling won't get the seller any thing. Just an idea for the future.
