    Ok, to keep this updated,

    I recently got a mail from the sellers wife, at least she claimed that she is his wife, the seller is in hospital after an accident.

    She told me that they got what I initially wanted to buy so I told her that I gladly would take it.

    Waiting for a response now.

    This is even more ominous. Accidents are of course an inconvenience but it sounds like they're saying you bought the 40gb so tough shit you are getting it and now he is allegedly injured there is nothing you can do about it? Injurd or not hsi bint can ask him a question and he can answer even if he has to do so in binary via blinking.

    Ring up the company to see if he answers or can be put on the 'phone to se if they are full of shit.

    Did trading standards reply?

    Also tell his bint you want a launch model to play PS2 games and it was wrongly advertised as a launch model. Make sure you print a virtual copy of the auction with his original wording too.

    I think what he meant to say is they have what he wanted in the first place (initially wanted, not intentionally), i.e. a REAL first gen console.

    Ok, so another 6 days passed by and again no reply on my mails, no PS3 in the mail and of course no refund...

    This is going to become a headache I guess...

    Edit: My bank told me that they cannot get my money back bc the seller need to give his ok for the transfer so WTF?

    Sorry to hear you're having problems. Once again, are you sure you've left enough time for them to send a console out? I don't know what their expected times are internationally, of course - that's why I'm asking.

    I'd say follow up with another phone call to the customer support number, and/or any number you can find. Ask what's happening. State that you'll be contacting Trading Standards and the Police at the end of next week if they have not sent you the goods and provided you with a tracking number or reversed the transfer.

    The seller is clearly a business, and therefore is subject to our laws on running a business. In particular, he mentions:

    Our returns policy is in accordance with the Consumer Protection (Distance Selling) Regulations 2000 and forms part of our Terms and Conditions of Sale.
    You'll have rights under those regulations:

    For example, note the right to cancel and the cancellation period.

    And, if he doesn't respond appropriately, do contact Trading Standards and perhaps even the Police.

    And definitely, above all else, report it to eBay! And once you've received your console or refund, leave bad feedback regardless. Make sure it's polite and doesn't give personal details, or eBay may remove it.

    It's certainly worth reporting to his local Trading Standards - who knows what they may dig up if they look at his business practices? ;-)

    You may want to see if a local like Kiff would be able to help out, of course. I'm not suggesting baseball bats at the ready, but a nice chat in person might help persuade them that they need to be dealing with this more swiftly.

    I've know people who have had dealings with trading standards and can say that when it comes to big businesses like Curry's (They refused to refund a laptop alltogether despite being within warranty) They are USELESS. Im not sure how they are when it comes to small businesses.

    This sounds like something that happened on an E30 forum recently. Long story short, someone received an item that wasn't as described, seller refused refund, forum members all chipped in some petrol money for the buyer to go to his house, 4 or 5 guys turn up at the guy's house in a van. Apparently, he was too scared to answer the door, so his parents came out and paid up.

    I bet it was past their 14 day right to return, though. A business doesn't have to REFUND for a product, even if faulty, past that time. They can opt to repair or replace it, though. THAT will be why Trading Standards didn't help.

    Check your consumer rights before slagging off an organisation that's there to help you in future.

    TBH warranty only really covers repairs or replacement if it is unrepairable. If they optd for th Curry's extended warranty these are all legalised scams and people should nver sign up for them unless they expect their stuff to break, but ther loopholes usually mean they won't pay up in a comedy amount of circumstances. Trading Standards couldn't really help you there, not with a dmand for a refund anyway, but they should have referred you to CAB to inform you of your rights.

    Also G0dlike did you try to call all of the sellers numbers?

    Christ, All I said was that other people had found them to be useless in cases. I never slagged them off.

    Because that's easy to do. Buy an empty case, get from Germany to England, find somewhere to buy explosives, fill the case, find the seller's house and cause an explosion.

    He'd then be even more out of pocket and get arrested! Great idea!
