So what are the chances of getting picked if you submit a dev application to xboxtlsm@microsoft.com has anyone here ever done it.

Its not a "chance" thing, if your application is good, you can get in.

If you are new to the business, not the field, the business, then odds are you WONT be able to "wow" them into giving you a kit.

oh yeah and is it possible you could get taken away by not releasing a game within a specific time period

can i also inquire as to whether anyone here has been accepted into the tools and middleware program and can you give some info about the proccess

You can inquire all you want but no one who has been accepted is going to tell you. Microsoft requires that you sign a NDA before they will even sneeze at you.

Nobody under NDA can tell you the process or policies that are required to get into the program.
